Agreement to Terms
By accessing or using the services provided by Sapphire Business Development ("Sapphire," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services Description
Sapphire provides managed WordPress hosting services, including but not limited to:
- WordPress site hosting and server management
- Site migration services
- Security monitoring and hardening
- Performance optimization
- Automated backups and restoration
- 24/7 monitoring and support
- Custom integrations and development
Account Responsibilities
As a client, you are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your site content complies with applicable laws
- Promptly notifying us of any unauthorized access
Acceptable Use
You agree not to use our services to:
- Host or distribute malware, viruses, or malicious code
- Engage in illegal activities or promote illegal content
- Infringe on intellectual property rights
- Send spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
- Interfere with the operation of our services or other clients' sites
- Host content that is defamatory, obscene, or harmful
Violation of these terms may result in immediate suspension or termination of services.
Service Level Agreement
We strive to maintain 99.9% uptime for all hosted sites. Our commitment includes:
- Proactive monitoring and rapid response to issues
- Regular maintenance performed during low-traffic periods
- Advance notice for scheduled maintenance when possible
- Transparent communication during service disruptions
Payment Terms
- Services are billed according to the agreed-upon plan and frequency
- Payment is due upon receipt of invoice unless otherwise agreed
- Late payments may result in service suspension
- All fees are non-refundable unless otherwise specified
- We reserve the right to adjust pricing with 30 days notice
Data and Backups
While we perform regular automated backups:
- Backups are provided as a convenience and not guaranteed
- You are responsible for maintaining your own backup copies
- We will make reasonable efforts to restore data from backups upon request
- Data retention periods are specified in your service agreement
Intellectual Property
You retain all rights to your content. By using our services, you grant us a limited license to host, display, and transmit your content as necessary to provide our services. We retain all rights to our proprietary tools, processes, and technologies.
Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount paid for services in the preceding 12 months
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for third-party services or content
- Force majeure events are excluded from liability
Termination
Either party may terminate services:
- With 30 days written notice for convenience
- Immediately for material breach of these terms
- Upon termination, we will provide reasonable assistance in migrating your data
- Outstanding fees remain due upon termination
Modifications
We may modify these terms at any time. Material changes will be communicated via email or through our website. Continued use of services after changes constitutes acceptance of the modified terms.
Governing Law
These terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation, and if necessary, binding arbitration.
